All software used on this website is the property of the Company or its software suppliers and protected by Canadian and international copyright laws.

You may use this website only if you have reached the age of majority where you live and you can form legally binding contracts under applicable law. You may not use this website if you live in a jurisdiction where access to or use of the website or any part of it may be illegal or prohibited. It is solely your responsibility to determine whether your use of this website is lawful, and you must comply with all applicable laws.

Neither the www.ajewel.co website nor its content may be, in whole or in part, copied, reproduced, republished, uploaded, posted, transmitted or distributed without the written permission of the Company, except that you may download, display and print the content presented on www.ajewel.co for your personal, non-commercial use only. Unauthorized use of www.ajewel.co and/or the content contained on www.ajewel.co may violate applicable copyright, trademark or other intellectual property laws or other laws. You must retain all copyright and trademark notices, including any other proprietary notices, contained within the content on this website. The use of that content on any other website or in any environment of networked computers is prohibited. You are prohibited from contributing, posting or transmitting to this website any infringing, unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane content or any content that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.” You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. The Company reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

In its sole discretion, in addition to any other rights or remedies available to the Company and without any liability whatsoever, 3DC ltd at any time and without notice may terminate or restrict your access to any component of www.ajewel.co.

 

1. User Name and Password

Your www.ajewel.co website account may be accessed only by use of your login name and password. You are solely responsible and liable for any use and misuse of your login name and password and for all activities that occur under your login name and password. For security reasons, you must keep your login name and password confidential and not disclose them to any person or permit any other person to use them, except an authorized representative of the Company. The Company recommends that you choose a password that is unique to you and not easily guessed by others. You should change your password on a regular basis, and you must log out at the end of each session.

All login names and passwords remain the property of the Company, and may be cancelled or suspended at any time by the Company without any notice or liability to you or any other person. The Company is not under any obligation to verify the actual identity or authority of the user of any login name or password.

You must immediately notify the Company of any unauthorized use of your login name or password, or if you know or suspect that your login name or password has been lost or stolen, has become known to any other person, or has been otherwise compromised

 

1. Privacy

You have read the Company’s Privacy Policy, the terms of which appear on www.ajewel.co and are incorporated into these Terms and Conditions, and you agree that the terms of that policy are reasonable. You consent to the collection, use and disclosure of your personal information by the Company in accordance with the terms of and for the purposes set out in the Company’s Privacy Policy. All login names and passwords remain the property of the Company, and may be cancelled or suspended at any time by the Company without any notice or liability to you or any other person. The Company is not under any obligation to verify the actual identity or authority of the user of any login name or password.

You must immediately notify the Company of any unauthorized use of your login name or password, or if you know or suspect that your login name or password has been lost or stolen, has become known to any other person, or has been otherwise compromised

 

1. Feedback

The Company enables visitors to www.ajewel.co to provide the Company with feedback by email or otherwise (“Customer Content”). If you provide Customer Content you grant the Company a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub licensable right to use, delete, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display that Customer Content throughout the world in any media, now known or later developed, for any purpose whatsoever, commercial or otherwise, without providing compensation to you or any other person, without any liability whatsoever, and free from any obligation of confidence, and you waive any and all moral rights in the Customer Content. You also grant the Company the right to use the name you submit with the Customer Content, if any, in connection with the Company’s rights set out in this section.

 

7.Order, Pricing and Fee Policy

Market conditions and competitive pressures may cause prices and availability of products, applications and services offered on this website to change without further notice. Additionally, although great care is taken in the production of the www.ajewel.co website, typographical, illustrative or pricing errors may occur. We reserve the right to correct errors at any time

All prices quoted are payable in the pound sterling (GBP) and, unless otherwise stated.

7.1 Placing an order. To order the 3D Model you designed or another 3D Model you found through our Services, you select the 3D Model. Then you can select the quantity of the 3D Model you order and the material you want the 3D Model to be made of. As the next step, we ask you to provide us with information we need for the delivery of the 3D Model. Finally you will be prompted for information required to initiate the payment. Depending on the payment method you select you may be redirected to a third party payment provider website. Please be informed that the language to be used during the whole ordering process is English.

7.2 Unacceptable orders, cancellation of orders by us. There are, however, technical or other reasons why ajewel.co may not accept or may cancel your order during the entire ordering process, even after our acceptance of your order. Such reasons can be, but are not limited to, the unfeasibility of the model, an infringing feature of your 3D Model, or the destination of the delivery you indicated in your order. In case we cancel your partial or entire order, we many contact you via email and, except in cases of fraud or other violations of our policies, issue you a full refund for the cancelled item(s).

7.3 Prices. The prices displayed on the Website are only indications and are valid only for the moment that they are displayed. ajewel.co reserves the right to change its prices on the website at any time without prior notice to you. Such change however will have no effect on orders completed before the posting of a new price on the website. We do our best to prevent errors in the pricing. However, should an error occur, we are not bound by our offer and may cancel the order. In the event of an error, any monies paid related to that order will be refunded to you.

7.4 Payment and price. The amount indicated on the ordering page includes the fee for the service (such as printing and packing the model), the price for the materials used to produce the 3D Model, and, if applicable, the markup charged by the designer. The price quoted on the Website includes shipping costs, sales tax (if applicable) but excludes any import duty or taxes (if applicable). ajewel.co offers estimated currency conversions as a courtesy to users. These estimates are not guaranteed and may not reflect actual currency conversation rates. If you pay in a currency that is different from the denominated currency of your payment method (which is probably the case if your bank or credit card account is not denominated in U.S. Dollars, Euros, pounds sterling), your payment company (such as your credit or bank card issuer) or third-party payment processor may apply a currency conversion rate or fees to your payment. Please contact your provider for information about these fees. These fees are not controlled by or known to ajewel.co.`

You can initiate your payment for your order via credit card, PayPal.com, or bank transfer. If you choose to pay using PayPal you will be directed to the PayPal.com website. In case you choose to pay by bank transfer you will receive the payment instructions via email from ajewel.co after confirmation of your order.

ajewel.co shall not be responsible in any way for the payment process done via the PayPal.com website. Please familiarize yourself with PayPal’s terms of use.

For orders paid for via credit card or PayPal, ajewel.co will begin production after authorizing and holding payment. For orders paid for via bank transfer, ajewel.co will begin production after the funds arrive in the ajewel.co bank account.

7.5 Acceptance After accepting your order we will send you an order confirmation by e-mail to the address associated with your ajewel.co Account. The order confirmation will be effective as of the date on which the order confirmation is sent to you. If we cannot accept your order we will contact you by email. You should verify the details in the confirmation email. If there are errors you should contact us as soon as possible by sending us an email.

7.6 Order Tracking Through the Website or – if you choose so – via e-mail notifications, you can track the status of your order e.g. accepted order, produced, Shipping, delivered etc.

7.7 Shipping Your order will be delivered to your shipping address. We deliver to multiple countries. You can only select those countries as your shipping address during the ordering process. We will use our commercially reasonable efforts to ship the 3D Model to the shipping address within the delivery time indicated in our confirmation email; nevertheless, depending on your shipping address it may take longer time. Any shipping and delivery dates given by us are only best estimates and we are not liable for any damage or cost caused by delay in shipping or delivery. Title and risk of loss is transferred to you upon transfer of the goods from ajewel.co to the shipment carriers.

7.8 Cancellation of your order, return of 3D Models. Due to the personalized nature of our Services (i.e. the 3D Model is supplied by us based on your specifications), you cannot cancel your order after it goes into production. Additionally, except where required by law we are not able to refund purchases of a “Gift Card” or a “Sample Kits” at any point. Orders that contain non-refundable items are still cancelable, however note that refund or cancellation will not apply to items in the order that are non-refundable.

7.9 Content Policy violations. If we determine that your model violates our Content Policy prior to printing, we will refuse to print the model and issue a refund. If we determine that your model violates our Content Policy after it has been printed, we will not ship the model and may not issue you a full refund.

The Company reserves the right to limit, reject, correct, cancel or refuse Orders, and to terminate accounts, in its discretion, including, without limitation, if the Company believes that customer conduct violates applicable law or is harmful to the interests of the Company or any Third Parties.

 

1. Warranty; Disclaimer

ajewel.co warrants only that the model manufactured by us will substantially meet the features of the indicated 3D Model within the limitations of the 3D printing technology. You maintain sole legal responsibility for the design specifications and performance of the 3D Model that is the subject of this transaction. ajewel.co does not give any warranty about the 3D Models themselves and does not guarantee that the 3D Model will be fit for any particular purposes. Please inspect the 3D Model upon receipt immediately. If the 3D Model is faulty when you received it and you believe you are entitled to a replacement in accordance with the warranty above, please contact us within 10 days after receipt of the 3D Model. Such warranty claim can be made only within 10 days after receipt of the model by you. Do not return the 3D Model unless we require you to do so. We reserve the right to condition any replacement or refund on the return of the 3D Model. We will confirm whether you are entitled to a replacement or refund. We reserve the right to condition your receipt of a replacement or refund on you providing us with photographs that we deem necessary to evaluate your claim. Transportation costs in respect of a faulty product will be borne by us. If we do not receive any notice within the provided 10 days we will assume the 3D Model meets your specifications and performance requirements. Models you have designated as “Print it Anyway” or its equivalent are not eligible for replacement or refund.

We have no special relationship with or fiduciary duty to you. You acknowledge that we have no duty to take any action regarding: (a) which users gain access to the Services; (b) what content you access via the Services; or (c) how you may interpret or use the content.

You release us from all liability for you having acquired or not acquired content through the Services. We make no representations concerning any content (including without limitation 3D Models) contained in or accessed through the Services, and we will not be responsible or liable for the accuracy, copyright compliance, or legality of material or content (including without limitation 3D Models) contained in or accessed through the Services.

THE SERVICES AND CONTENT ARE PROVIDED “AS IS”, “AS AVAILABLE” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE OR USAGE OF TRADE, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. WE, AND OUR DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, PARTNERS AND CONTENT PROVIDERS DO NOT WARRANT THAT: (I) THE SERVICES WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (II) ANY DEFECTS OR ERRORS WILL BE CORRECTED; (III) ANY CONTENT OR SOFTWARE AVAILABLE AT OR THROUGH THE SERVICES IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR (IV) THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. YOUR USE OF THE SERVICES IS SOLELY AT YOUR OWN RISK. SOME STATES DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE FOREGOING LIMITATIONS MAY NOT APPLY TO YOU.

PLEASE NOTE THAT, UNLESS OTHERWISE STATED IN THE DESCRIPTION FOR A SPECIFIC MATERIAL, THE MATERIALS WE USE FOR MANUFACTURING THE 3D MODELS MAKE THE 3D MODELS SUITABLE ONLY FOR DECORATIVE PURPOSES AND THEY ARE NOT SUITED FOR ANY OTHER PURPOSE. THE 3D MODELS ARE NOT SUITED TO BE USED AS TOYS, OR TO BE GIVEN TO CHILDREN. THE 3D MODELS SHOULD NOT COME IN CONTACT WITH ELECTRICITY OR FOOD OR LIQUIDS AND SHOULD BE KEPT AWAY FROM HEAT.

Without limiting the generality of the foregoing, we assume no responsibility or liability for the selection of materials. You maintain sole legal responsibility for the selection of materials that fit the requirements of your specifications and performance of the 3D Model.

 

1. Liability disclaimer – READ THE FOLLOWING CAREFULLY

Except as explicitly provided in these Terms and Conditions as amended from time to time, the Company and the Third Parties make no representations or warranties of any kind, express or implied, regarding www.ajewel.co and any of the Messaging Botsand/or any content, products or services provided on www.ajewel.co or on any of the Messaging Bots, all of which are provided on an “as is” and “as available” basis. The Company and the Third Parties do not warrant the accuracy, completeness, currency, reliability or suitability of the operation of www.ajewel.co or any of the Messaging Bots, or any of the content or data found on www.ajewel.co or on any of the Messaging Bots, and expressly disclaim all warranties and conditions in respect of www.ajewel.co or any of the Messaging Bots, its content or data, and any products, services or applications offered for sale on www.ajewel.co or on any of the Messaging Bots, including implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement, and those arising by statute or otherwise in law or from a course of dealing or usage of trade.

The Company and the Third Parties are not responsible for late, lost, incomplete, illegible, misdirected or stolen messages or mail, unavailable network connections, failed, incomplete, garbled or delayed computer transmissions, on-line failures, hardware, software or other technical malfunctions or disturbances or any other communications failures or circumstances affecting, disrupting or corrupting communications.

The Company and the Third Parties assume no responsibility, and will not be liable for, any damages to, or any viruses affecting your computer equipment or other property on account of your access to, use of, or browsing on www.ajewel.co or your downloading of any applications, materials, data, text, images, video or audio from www.ajewel.co.

 

1. Maximum Liability

If the Company or any of the Third Parties should be found liable for any loss or damage which arises out of or is in any way connected with any of the functions or uses of www.ajewel.co or of any of the Messaging Bots, or their content, or any of the products or services offered on www.ajewel.co or on any of the Messaging Bots, the liability of the Company and the Third Parties will in no event exceed in the aggregate the amount paid by you under these Terms and Conditions for the specific Order to which the loss or damage relates.

In no event will the Company or any of the Third Parties be liable for any injury, loss, claim, damage, or any special, exemplary, punitive, direct, indirect, incidental or consequential damages of any kind (including, but not limited to economic loss, lost profits or lost savings), whether based in contract, tort, strict liability, or otherwise, which arises out of or is in any way connected with any use of www.ajewel.co or its content, the operation of this website or any failure or delay in the operation of this website (including, but not limited to the inability to use any component of www.ajewel.co or of any of the Messaging Bots for Orders), or any of the applications, products or services offered on www.ajewel.co or on any of the Messaging Bots, even if advised of the possibility of damages.

 

1. Acknowledgement

The exclusion of certain warranties and the limitation of certain liabilities is prohibited in some jurisdictions. These statutory prohibitions may apply to you, and the Company acknowledges that in that case, parts of these Terms and Conditions will not be binding upon you.

 

1. Indemnification

You will indemnify and save harmless the Company and the Third Parties and their respective officers, directors, employees, consultants, representatives and agents from and against any claim, cause of action or demand, including without limitation reasonable legal, accounting and other professional fees, brought as a result of your use of www.ajewel.co.

We rely on the information you provide through this website, including registration information (name and email address), payment information (credit card numbers and expiration dates), and transaction-related information, which must be true, accurate, current and complete. You will be solely responsible and liable for any and all loss, damage, and additional costs that you, we or any other person may incur as a result of your submission of any false, incorrect or incomplete information or your failure to update your registration information and payment information within 30 days of any change.

The www.ajewel.co website contains links to websites owned or operated by other entities which are not associated or affiliated with the Company or the Third Parties. These links are provided solely as a convenience to you and the inclusion of any link does not imply endorsement, investigation or verification by the Company or the Third Parties of the linked website or information contained in the linked website, or of their security or privacy practices. The Company and the Third Parties will not be responsible for the content of any other linked websites and makes no representation or warranty regarding any other websites or the contents on those websites. If you decide to access other websites, you do so at your own risk. Framing of the www.ajewel.co website or any of its content in any form and by any method is strictly prohibited.

Linking to any other website is at your sole risk and the Company will not be responsible or liable for any damages in connection with such linking. In addition, the Company does not endorse or approve of any websites linked from or to www.ajewel.co, except for other websites operated by the Company.

You may not gather, extract, reproduce and/or display on any other non-Company website or other online service, any material on or from www.ajewel.co, whether or not by the use of spiders or other ‘screen scraping’ software or system used to extract data without the express consent of the Company.

If you download any software, we are not responsible or liable for any difficulties or consequences associated with downloading that software. The use of any downloaded software is governed by the terms of the applicable license agreement, if any, which accompanies that software or is provided with that software or in these Terms and Conditions.

The provisions above that follow the heading “Liability Disclaimer” will survive the termination of your access to www.ajewel.co.

 

1. General Relationships

The relationship between the Company and you will be that of independent contractors, and neither of us nor any of our respective officers, agents or employees will be held or construed to be partners, joint ventures, fiduciaries, employees or agents of the other as a result of these Terms and Conditions or your use of www.ajewel.co.

 

1. User Generated Content

The term “User Generated Content” when used in this Terms and Conditions shall mean any content uploaded to the Website, the Application, the Platform, or the Services by you, including but not limited to all uploaded 3D Models, pictures of 3D Models, comments on the Website, specifications provided in your order for a CoCreator model (a “CoCreator Model”), as well as the printed 3D Model we create for you based on your User Generated Content. All User Generated Content should not be or contain abusive, harassing, threatening, defamatory, obscene, fraudulent, deceptive, misleading, offensive, pornographic, illegal or unlawful information or be likely to infringe or infringing on any intellectual property rights. Intellectual property rights means copyright, patent, registered design, design right, trademark, trade secret or any other proprietary or industrial right.

ajewel.co has no obligation to review the User Generated Content and can in no way be held responsible for the content of the User Generated Content. Opinions expressed in the User Generated Content are not necessarily the opinion of ajewel.co.

Please note that we do not seek any unsolicited ideas or improvements for ajewel.co Services and that any unsolicited ideas or improvements you submit are deemed User Generated Content and licensed to us as set forth below. In addition, ajewel.co retains all of the rights held by members of the general public with regard to your unsolicited ideas and improvements. ajewel.co’ receipt of your unsolicited ideas and improvements is not an admission by us of their novelty, priority, or originality, and it does not restrict ajewel.co’ right to contest existing or future intellectual property rights relating to your unsolicited ideas and improvements in any way.

Except for your 3D Models, which are referenced below, by submitting User Generated Content through the Services or Website, you hereby do and shall grant us a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable license to use, edit, modify, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User Generated Content in connection with the Website, the Applications, the Services and our (and our successors’ and assigns’) businesses, including without limitation for promoting and redistributing part or all of the Website, the Applications or the Services (and derivative works thereof) in any media formats and through any media channels (including, without limitation, third party websites and feeds). You also hereby do and shall grant each user of the Website, the Applications, or the Services a non-exclusive license to access your User Generated Content through the Website, the Applications or the Services, and share your User Generated Content on blogs and social media, provided such sharing prominently links back to the model page on the ajewel.co site and is not done on a site that competes directly or indirectly with ajewel.co Services. For clarity, the foregoing license grants to us and our users does not affect your other ownership or license rights in your User Generated Content, including the right to grant additional licenses to your User Generated Content, unless otherwise agreed in writing. You represent and warrant that you have all rights to grant such licenses to us without infringement or violation of any third party rights, including without limitation, any privacy rights, publicity rights, copyrights, contract rights, or any other intellectual property or proprietary rights.

 

1. Intellectual Property Rights of 3D Designs

You, as a designer, retain all your intellectual property rights in your 3D Models, including without limitation any and all derivative works like 3D renders. Except for the rights and licenses with respect to your 3D Models specified below, ajewel.co shall not use, modify or display your 3D Models or derivatives thereof. By uploading your 3D Models to the Services, you represent and warrant that it is your original creation and not copied from any third party and/or entity. You further represent and warrant that you have all rights to grant the below licenses to us without infringement or violation of any third party rights, including without limitation, any privacy rights, publicity rights, copyrights, trademarks, contract rights, or any other intellectual property or proprietary rights.

By uploading your 3D Model to the Services, you grant ajewel.co a non-exclusive, royalty free, worldwide, transferable, and sublicensable right and license (i) to use your 3D Model for the manufacturing of your 3D Model in order to fulfill your order; (ii) if you offer your 3D Model for sale through ajewel.co, to use your 3D Model for the manufacturing of your 3D model in order to fulfill orders of your 3D Model made through ajewel.co (iii), if you indicate that you want your 3D Model to be a CoCreator Model during the upload process (a) to display such CoCreator Model on the ajewel.co Website and (b) to use and modify such CoCreator Model for the manufacturing of your model in order to fulfill the order of any other user of the Services; (iv) to generate and display 3D renders of your 3D Model; and (v) to use the 3D Model as necessary for the operation and maintenance of ajewel.co Services including without limitation for the internal testing and educational purposes of ajewel.co and ajewel.co manufacturing partners.

You can change the rights for CoCreator Models via the model detail page of the 3D Model at any time; provided that any then-pending order for such 3D Model shall be fulfilled by ajewel.co. With regard to any non-published 3D Model, in order to protect third party intellectual property right owners who, we retain the right to review and refuse any order when it, in our sole and exclusive discretion, appears to infringe third party intellectual property rights.

By removing your 3D Model from the Services, you terminate all licenses granted to ajewel.co and its users to such 3D Model under these Terms and Conditions; provided that ajewel.co is entitled to use your 3D Model to fulfill orders of your 3D Model that were placed before the removal and may continue to use the model for internal testing and educational purposes. Note, specific terms in the Co-Creator section: As a customer of a CoCreator Model, by providing specifications for a CoCreator Model, you grant ajewel.co a non-exclusive, royalty free, worldwide, transferable license to use, copy, modify, display and distribute your specifications, with the right to sublicense, for any purpose.

Please note that any intellectual property right of a manual CoCreator Model created by the ajewel.co shop owner with the use of your specifications will vest in the shop owner who created such CoCreator Model.

 

1. Governing Laws, Jurisdiction

You consent and submit to the exclusive jurisdiction of the courts located in the City of London, in the Province of England UK, in all disputes arising out of or relating to the use of www.ajewel.co and these Terms and Conditions. This agreement and its performance will be governed by the laws of the London, UK, and the federal laws of UK applicable in that Province.
